I understand that this Agreement, along with payment of certain agreed upon fees, allows Me to be a client of NineGPS LLC.
I understand that this Agreement may be terminated at any time by either party and that there will be no refunds of any fee(s) whatsoever.
I understand that NineGPS LLC reserves the right to deny Me its services for any reason and in its sole discretion.
In consideration of participating in one or more of NineGPS LLC’s services and programs, I hereby represent that I am at least 18 years old and single – eithernever married, divorced, or widowed.
NineGPS LLC warrants that it will respect My privacy, never selling or giving My private information to any third party vendor, site, or company without My expressed permission. I agree to provide accurate, current and complete information about Myself to NineGPS LLC for the purpose of participating in or of NineGPS LLC’s services. Further, I agree to update said information in a timely manner – particularly around relationship status – if it changes at any time throughout the term of my agreement with NineGPS LLC.
I agree that NineGPS LLC may disclose certain information regarding Me that I provide to it for the purpose of matching me with a prospective date(s) such as providing such prospective date(s) with some personal and contact information. I understand and agree that NineGPS LLC may also disseminate My personal information if it is required to do so by law; or if it has a good faith belief that disclosure is necessary to comply with the law or with legal process served upon it; or to protect and defend its rights or property; or to act in an emergency to protect the safety of Me or another.
I understand that while NineGPS LLC will make every effort to do so, NineGPS LLC does not guarantee results. There is no express or implied warranty or promise that a spouse or life partner can or will be found . I therefore agree that NineGPS LLC cannot be held responsible for My failure to find a suitable spouse or life partner.
I understand that NineGPS LLC makes no representations or warranties, either express or implied as to the accuracy or authenticity of the information furnished by its Members. Because NineGPS LLC makes no representations whatsoever regarding any individual, I understand that I must make every effort to satisfy Myself that the individual with whom I plan or agree to interact with is safe, trustworthy and acceptable to Me. I hereby expressly, voluntarily, and knowingly agree to fully and completely assume the risk of interacting with any individual(s) with whom I come in contact with either directly or indirectly by virtue of my use of NineGPS LLC’s services. In further consideration of participating in one or more of NineGPS LLC’s services and/or programs, I agree to fully and completely indemnify and hold harmless NineGPS LLC, its principals, owners, officers, directors, employees, heirs, successors and assigns, from any and all damages (including, but not limited to costs of defense, attorneys fees and costs of court), claims, causes of action, suits, demands and liabilities of whatever nature whatsoever, including, but not limited to damages for personal injuries and emotional distress that arise either directly or indirectly as the result of any service(s) provided by, or any action or failure to act on the part of, NineGPS LLC, whether during the term of this Disclaimer or at any time thereafter. The foregoing extends to any claim(s) for the improper or negligent dissemination of private, unauthorized or inaccurate information regarding Me, that it placed Me in a false light, or that I relied to My detriment on any representation, information, opinion, or advice provided by NineGPS LLC. If I have a dispute with one or more of the individuals with whom I come in contact with either directly or indirectly by virtue of my use of NineGPS LLC’s services, I release NineGPS LLC from any of the above listed damages, claims or causes of action. Further, the terms and conditions of this Disclaimer inure to and are binding on my heirs, administrators, executors and representatives.
I expressly agree that this Disclaimer is intended to be as broad and inclusive as permitted by the laws of the State of Georgia, and that this Disclaimer shall by governed by and interpreted in accordance with the laws of the State of Georgia. I agree that if there is any dispute with NineGPS LLC, it will be resolved by binding arbitration in the State of Georgia, based upon the rules of the American Arbitration Association and Georgia law. I agree that in the event that any clause or provision of this Disclaimer shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Disclaimer which shall continue to be enforceable.
